I don't think we are wasting energy/time by identifying gaps and answering questions to folks who want to know more about what exactly are we talking about here. Moving on and gaining more and more support etc., all these things need to be done in parallel.

Wanting to know more and talking trash/dumb - 2 different things.

Yes we are here to clarify for the former. For the later, is what my original comment was.

Also like i mentioned before, did we do some analysis on the links MadhuVJ sent few days ago?. I will be calling few lawyers today and keep you all posted

My status on CRIS has changed. No emails. Its says my approval has been sent. But nothing about the card. I spoke to the CS and they said my biometrics have to be uploaded. In the mean time can I get my passport stamped?.

Could you tell me your PD, RD, ND and service centre please?..

My situation is not any better. I am working for a GA based company since 2001 got stuck in the backlog center with Priority Date Oct 2003 (labor apporved in Nov 2006 I-140 applied in May). After calling the company HR for 30-40 times in last one week I was able to talk to HR guy, he said the ceo will allow only those who have approved I-140 to apply for I-485. He also said then once priority date retogressed again I will be able to get 3 years H1B ext. that will be good for me. I think these desi blood sucking compnies will be obsolete in couple of years. If USCIS make the rules better.

I was thinking of disclosing my employers name but then I will never be able to file I-485

By Self employment, do you mean working on 1099 or by starting a business and working for it?

By self employment I mean Starting a business of my own and working for it. ?

Also what if ( a big if ) somebody has an already existing profit making business and wants to work for it ?

    thanks

I agree: you should take legal advice from as many attorneys as possible. In my experience with multiple attorneys on these topics (i.e., self-employed vs. W2 on EAD, and "filing" AC21), I got conflicting pieces of advice. So the only resources I could base my thinking on are USCIS and IRS.

    Supreet -

I strongly dispute that. I encourage you to consult an attorney before taking any action.

AC-21 job must be "permanent and full-time" just like I-140. Simple. Infact, please put your question in attorney forum and get it confirmed right there.

I thought of going back after getting citizenship, but that would be another 8-9 years at the least. I would miss the big ride in India. When I went there(Coimbatore, Tamil Nadu) 3 years ago, I did not like it that much. But I see a big change in the last 3 years. Infrastructure is improving. Few of my friends have already gone back and are pretty happy over there.

I am from Hyderabad, l left that city in 1999 to do my MS, got my MS, switched a couple of jobs as i thought career growth / job satisfaction was more important than filing a GC, finally my present company filed my GC in 2009 (PD 2009), I am fed up of this laborious process, not everyone can take it, and I am one of them, and as I get older, I am getting more conservative and I find it difficult to adjust here. I am visiting India this year, if everything works out, I will be heading back, even with all the complaints about India, it still is my country of birth, and there is a saying, "Janani Janma bhoomishya swargadapi gariyasi", translated, Mother and motherland are superior to the Heaven.

Excuse me for being a little blunt...but

People really need to stand up and see what it takes to bring about change. People are loathe to drive 10 miles and attend a state chapter meeting, and you want to overhaul a system to the extent that you get credit for time/experience in US?

I am not saying its a good or bad thing. What I am saying is, what you are asking for is a major overhaul. GC is driven by A PARTICULAR POSITION offered by A PARTICULAR EMPLOYER, where its proven that NO US CITIZEN WAS WILLING, QUALIFIED AND ABLE TO do the job. How can your previous job get you credit for such a position and petition driven GC process? If you want that, then system needs major change where GC is not drive by one particular job offer from one particular employer who sponsors you.

So basically, you are looking for a RADICAL change in the system. Nothing wrong with dreaming, but kindly show some friggin activity and effort on your part before putting up new ideas on forums.

Otherwise if you are sitting around and

    1. Offering new innovative ideas for GC reform on forum posts that lawmakers dont read.

    2. Never go to lawmaker meetings in DC or locally or attend any local meetups of IV.

    3. Cancel recurring contributions as soon as your EAD card shows up in your mailbox.

Then please, keep your really creative and excellant ideas to yourself. Because Ted Kennedy is not going to change the system and give you credit for working here since 1999 or 1929 and reset your PD to 1999 or 1929 BASED ON YOUR BRILLIANT IDEAS on forum posts.

Everybody has been waiting for his/her green card and congratulations to all those who has got their GC. On the other hand it is really unfair and to some extent unethical on the part of USICS not follow a fair system.
There are several people in 2004, 2005 who have been paitently waiting for their turn only to see that people behind them getting approved.
Several of us have writtent to Ombudsman, Director but of no avail.
Not sure what else can be done? Any Idea? Do we have any liaison with AILA who can take up this matter.

    Sunny Surya,

With all due respect let me make a couple of observations here.

    1) First you file a lawsuit that prevents fellow Eb3's from porting to Eb2 at a later date, even though those individuals may have advanced in their careers and would be eligible for better jobs.

    2) Now that you have successfully broken a united community into two factions, you want the IV core to now further take up the "Eb2 cause" against the USCIS, because YOU cannot file a lawsuit against the USCIS (the 500 pound gorilla) an organization that doesnt give a c**p about the immigrants and even its own internal processing "rule"?

    3) Let me ask you, WHY should the IV core help ONLY the Eb2 at this point. You and some other Eb2 members were and are flexing your muscles against the Eb3 members who have been suffering in the EXACT same manner. What exactly have YOU contributed towards uniting the Legal employment based community and what have YOU done to help the Core team so far, that you now ask the core team to specifically take the Eb2 non-sequential processing up with the law-makers?

If you see a problem with the non-sequential processing, why dont YOU write to your own senators/congressmen and ask them to follow up on your individual case?

One more thing, if you are planning on replying back saying that "This is my last post on IV" so be it. IV does not need members who think of just themselves. And yes if you are planning on giving me red/gray/green dots please feel free to do so.

    Thanks!

I am pasting his 3 remarkable postings. We can see his courage to face the destiny. He thinks about his family, and see them settle in a stable country before his end. He is saying good bye to IV readers on his last post.

    Gurus,

I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.

I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

    Please help.

    Mehul

Let me answer that. I am from Fiji but I was born in India so I am stuck with rest of you and for my family going back is not an option. Fiji is very hostile to indians living there so for us it's here or nowhere. May be india is an option but we have very few distant relatives in India as both of our parents has passed away.

Though it is a big shock for me and my family, I have to get over it and think about their survival after me.

My apologies if I have given the impression as GC greedy but I can understand how difficult it is for someone to understand how is life without something you can call a "Home"

Thank you all for your help and support but I have made peace with my fate. I have pancreas cancer with VERY poor pragnosis and trust me I took 5 different opinions with the some of the best hospitals in US and Europe.

Regarding my family, something is working out in Sweden and probably all of us will move there permanently in 1-2 months. We have some relatives living there.

Thanks again for all you help. You guys really made us feel we are not alone.

    Good luck and Good Bye.

    Mehul

    The news is terrible...

But I admire the courage he showed during his difficult times.

I agree with you dealsnet. We, the members of IV, should take up this issue and try to help his family.

ArkBird, any ideas how we can help?

    A Great New Commission
    May 27, 2007

    An Open Letter to:

    The United States Senate
The United States House of Representatives

    Re: A Great New Commission

    Ladies and Gentlemen:

Our nation holds paramount equal treatment under the law. My principal question is, what federal laws may I break so that I am rewarded with amnesty to the tune of $18,000 per year?

That would bring me parity with the estimated costs to society of illegal aliens. These are in health, education and related social benefits. Oh, and the approximately 30 percent of our prison population which is comprised of some of these aliens. Seems some of the cost is borne by victims who are assaulted by aliens doing the crimes Americans just wont do.

Ill even give you a bargain. As a small business owner, my real and opportunity costs to comply with federal statutes and regulations are substantial. These are not taxes, they are non-deductible costs I incur to comply with federal law. My daughters chronic medical condition and my own heart condition also incur substantial expenses. Regarding our health, my family is uninsurable due to these conditions. We have never received assistance under any state or federal programs.

All of these costs come to something over $27,000 per year. So, when you give me my amnesty and my $18,000 per year, you will fall short of my expenses by approximately $9,000. Since you are wise in the ways of federal accounting, you can inform your constituents that you have in fact saved $9,000 per year, in addition to the moral claim of having granted me amnesty.

It will be appropriate to consider that in fairness my children should be due anchor amnesty. This from the fact that they still will be my dependents when you soon grant me amnesty. If you delay, well, my daughter will always be my dependent.

Considering possible delays, especially since fellow citizens will have their own tailored amnesty petitions, I understand if you need to charter a Federal Amnesty Commission. That is sure to renew respect for and compliance with the laws you draft. Any shortfall in compliance, up to say, twelve million offenses, you could graciously accept as appropriate civil disobedience. After all, that would assure you more press time as we enter this latest election cycle.

You are wise also in federal laws which may be broken with no consequence. I am too busy supporting my family, you, and the twelve million scofflaws and their employers to understand such matters, so I need your guidance. You know where I live, my drivers license number, my social security number, my bank and credit account numbers, as well as my email, internet service provider, taxpayer identification number, mortgage holder, business licenses and telephone numbers.

Please contact me soon. Given the rising medical and other costs, I need that $18,000 quickly and retroactive to the enactment date of S.1348. Its only fair.

    Cordially,

    <First Name> <Last Name>

    Desi393, FinalGC, Ramba:

You've mentioned a few times on this forum that on AC21, the job needs to be "permanent." That is misinformation.....

    First read this post.

    http://immigrationvoice.org/forum/473142-post12.html

This should clear your doubt. You can read RFE issued by USCIS on other forum as well. The word "permanent" is right there.

I like the idea. Why only secretory of Homeland security only. Cover White House and Speaker of House and Majority Senate leader.

We need systematic planning and coordination. The letter should have background picture of Gandhiji and footnote should contain famous quote of Gandhiji.

Anyway good idea to have attention of media and lawmakers.

Your case is like me, except I am porting Priority date from my previous approved I-140 Eb3 case. Your new I-140 transferred to Texas Service centre because your employer comes under Texas Service centre. Your residency location also comes under Texas service centre. So you will receive I-485, I-765 and I-131 with SRC numbers. But it may take longer time.

Good thing is Texas Service center is processing I-140 applications in May 2007. Max they are taking 5 months. People are discussing about LUD, it doesn't matter. It seems Texas service centre doing some regular maintenance. If you register your old approved H1s, their LUDs also changing.

Texas Service Centre data entry dates:
    I-140 - 07/31/2007
    I-485 -- 06/28/2007

    I-140 Direct filing locations

Thanks for the info... and sounds good to see that the I-140 takes less time in this center... I hope I will get something soon...Do you know if I can get Finger Prints notices or my EAD without the Receit Notices??? or I need to have that first before start getting something else???
