    It looks like USCIS has indeed pre-adjudicated a lot of cases - if processing times at the various Service Centers are any indication, then the USCIS is almost done.

    From now on, USCIS will be able to make a more accurate and realistic demand for visa numbers to the DOS. This means the dates will move forward gradually - with a measured jump in the last month of the last quarter.

    For FY10, the jump in the last quarter will depend on:
    1. State of the US Economy - If it continues to be L shaped, then less demand from EB2ROW and EB2I dates my advance up to mid 2006.
    2. China EB2 - The faster it moves, the further EB2I will advance. It was suprising to find that EB2 China is back in 2005. Either the DOS has been really conservative or USCIS has truly done some house cleaning.

    Looks like they are processing EAD and AP (in the mail room itself:) ) along with receipts. No point in touching the same application twice or thrice. If you get a receipt then you should also get EAD and AP:):).

    It's very frustrating.. TSC is sitting on our application or what? Approx 30K application are there for July 2nd filer including NSC->TSC transfer(per old NYT report). We see reporting of 1 or 2 receipting a day then few quite days. :mad::mad::mad:
    It will approx 60 days since filing and still waiting for Receipt. What a heck..

    My question is - has anobdy got their cards without getting the CPO e-mail - I have recd the approval notice on 11th in the mail - but I have yet to get the cards also I did not get the CPO e-mail:confused:

    I was approved on 8-12-08, received approval letter too.

    after that no soft luds updates....

    No Welcome notice or COP

    how about sending it to Michael Chertoff and Condelezza Rice??

    IV core cannot "officially" endorse this... We are on our own.

    As for sending flowers to Chertoff or Rice - It is good but let us stick with one person for now (Emilio). Unless you are willing to send to all three :). It will seem like there is more unity amongst us if we send more "number" of flowers.

    Thank you all for your wonderful responses, I am overwhelmed by the feedback. Some of you have posted such detailed things and personal information, for which I am very grateful. I intend to print out the thread and keep it on my desk for instant inspiration :)

    Matthew Oh has summarised the predicament of folks in a situation such as mine:

    12/16/2007: India EB-2 Retrogression for Two Years and 2002 and 2001 Priority Date Applications

    Traditionally, the legacy INS and USCIS have been exercising its discretion more or less expediting those cases whose visa numbers would be retrogressed substantially to relieve them from the hardship. We have no information available about the number of Indian EB-2 cases with the priority dates between January 2002 and January 2000. These cases are available for adjudication in December 2007. These cases could have been those received approval of the traditional labor certification cases which were approved before October 1, 2007 by the DOL Backlog Elimination Centers. Unfortunately, the huge retrogression will occur during the nation's most celebrated year-end holiday period when the working days and adjudication resources will be very limited. We trust that the USCIS leaders are and will be doing everything possible to adjudicate these Indian cases before the end of the year.

    1. Do I need a Green card at ANY cost ( Any cost = Waiting for yrs, Not willing to risk any other options, afraid to raise issues, not pinpointing flaws )

    2. Willing to fight for justice.

    If you chose the option 1, please stop reading further and good luck.

    For the option 2, here we go.I am new to this web site and it seems there are approx 70k people here and lot more outside. Huge enough to create miracles.

    Just to remind ourself who we are. We are Highly skilled LEGAL immigrants. It not only means we are skillful but it also means we pay every damn tax which is out there. We pay for welfare. We pay for unemployed. We pay for pensioners. List goes on. We pay fees for every application processed by USCIS ( Labor, I-140,I-485,I-765,I-131 etc etc ). We pay rent. We buy cars. We buy houses. In short, we are nothing but GOLD to this economy.

    However, this one department called USCIS is literally toying with us for yrs now as if we are slaves or we are obligated to them. We dont want anyone to do us any favour. We need justice.

    Friends - I have self respect and i wasn't born chanting Green Card. I AM going to face them, confront them, demand them to provide justice, if not I want them to REFUND every penny i have paid so far. If this "I AM" becomes "WE", half the battle won. TOGETHER WE STAND, VICTORY/JUSTICE FOR ALL. If you are still hesitant, you made a bad choice of choosing option 2. Please go back to option 1.

    AC-21 job must be "permanent and full-time" just like I-140. Simple. Infact, please put your question in attorney forum and get it confirmed right there.

    Thanks for the clarification. Hope USCIS/DOS will release clear information on total pending cases.

    If I know for sure that I will only get GC after a decade or so, I might as well go back. With 3300 visas for EB3-I, one decade for the PD to reach 2004/2005 seems very likely.

    There are still lots of cases in eb3 from back that far.

    Many of the eb3 245i cases; there dependents were outside USA. Once; they got greencards; then their dependents went for consular processing or are going for consular processing.

    One of the cases I worked on ability to pay; person had adopted her nephew so that he could get greencard as dependent. You couldn't even begin to imagine how many cases like this there are.

    Up until July 29, 2007 (incl.) when sorting of files was going on, NSC did a load sharing of files with TSC. (and btw they did not look at where ones' I-140 is adjudicated when making the selection, it was random. I know several such cases)

    This in my opinion is a very good way of making sure adjudicating resources are kept in balance at both centers.
    Like somone quiet rightly pointed out it is akin to the old Labor Certification process where some states were way faster than others (less demand faster process).

    In the direct filing which started July 30, 2007 the load sharing has a great possibilty of being tilted one way or the other (though maybe not as much as old LC's). They have made a geographical distribution and not one that factors # of applications traditionally received from states.

    On the other hand, may be USCIS has figured that the particular geographical jurisdiction produces the right load sharing between NSC and TSC!

    CA and NY were the two states which were always backlogged during those bad old days of labor processing. Now, CA application goes to TSC and NY goes to NSC and that might keep both the centers balanced going forward.

    But I think rather than dividing based on the states, they should rather do a load balancing based on the request coming..just like our network works :)
    Load balancing can be simply based on the round robin fashion..one goes to TSC other goes to NSC and so on.
    How difficult is to build that kind of system and to keep it balanced and fair for all.
